Overview

The Associate Counsel position provides legal support in connection with the Company's compliance with federal, state and local labor and employment laws, rules and regulations, including EEO, traditional labor, leave laws, wage and hour laws, prevailing wage laws, immigration, and health and safety laws, and support regarding the negotiation and implementation of the Company's labor contracts. The Associate Counsel will be expected to represent the Company in state and federal court and before local, state and federal administrative agencies, support and appear at union grievance-arbitration hearings, and counsel Company management on a wide variety of labor and employment law matters. The individual filling this position will be expected to work independently on matters of moderate or high complexity, handle and/or manage complex projects and meet deadlines and make verbal and written presentations to Company management regarding compliance with new and existing labor and employment laws.

Responsibilities

Core Responsibilities
  • Represent the Company in federal, state and local court and administrative proceedings and to negotiate and/or litigate in connection with labor and employment compliance matters of moderate to high complexity.
  • Provide advice and counsel to Company management on compliance with federal, state, and local labor and employment laws, rules, and regulations.
  • Support Company management in the negotiation, implementation, and interpretation of the Companys labor contracts.
  • Oversee or conduct legal research, write legal memoranda and briefs and draft contracts.
  • Provide any other labor and employment-related legal services related to Company operations.
  • Perform administrative matters in connection with the operation of the Law Department.
  • Work with and manage or oversee outside counsel on matters as needed or required.
  • Perform other related tasks and assignments as required.

Qualifications

Required Education/Experience
  • Juris Doctorate J.D. Degree from a recognized and accredited law school.
Relevant Work Experience
  • Must be admitted to practice law in the state of New York, required.
  • A minimum of 10 years legal experience with a focus on labor and employment matters (including administrative and judicial proceedings), required.
  • First chair deposition experience required.
  • Must possess excellent presentation, interpersonal, written and oral communication, litigation and negotiation skills, required.
  • Experience with OSHA, ERISA, Immigration, preferred.
  • First or second chair trial experience, preferred.
  • Experience litigating wage and hour claims, preferred.
  • Experience with sate and local prevailing wage laws, preferred.
Licenses and Certifications
  • Driver's License Required
Additional Physical Demands
  • Must be able to respond to Company emergencies by performing a System Emergency Assignment to restore service to our customers.
  • Must be able and willing to travel within Company service territory, as needed.
