Summary

Project manager for prevailing wage compliance at Palo Verde Generating Station. Researches tax law and proposed federal legislation. Writes memorandums to advise PWCC, APS, and affiliates with respect to the actual or potential impact of such law or proposed legislation. Advises internal clients of the tax consequences of transactional proposals and contracts. Independently prepares tax planning ideas/identifies tax saving opportunities. Negotiates with tax authorities on audit issues. Serves as the prime spokesperson for the organization on highly significant tax matters.

Minimum Requirements

  • Post graduate degree in law or taxation required.
  • Minimum eight (8) years significant experience in tax research and planning with at 5 years experience in a corporate law or accounting firm.
  • Minimum three (3) years of utility experience preferred.
  • CPA and/or law license also required. JD or LLM preferred.
  • Thorough knowledge of tax law and research techniques, contract drafting techniques and negotiating skills in highly adversarial environments.
  • Possesses broad business background, problem-solving skills, interpersonal communication, and negotiating skills.

Major Accountabilities

1) Manage APS's annual Section 45U prevailing wage compliance process for Palo Verde by coordinating internal teams, vendors and external advisors; determine in-scope employees and contractors, assign DOL job classifications, gather payroll data, support analysis, prepare compliance documentation, and report results to APS and Palo Verde leadership.


2) Analyze proposed transactions for income tax effects and propose solutions to problems uncovered and examine alternatives.

3) Provide draft tax and other language for transaction contracts and agreements.

4) Advise accounting department, HR, and Treasury as needed, on changes in law affecting payroll taxes, executive compensation and taxation matters of employee benefit and payments for both benefit plans and employees.

5) Research and write memoranda, briefs, and protests on issues of tax law.

6) Analyze proposed federal tax legislation, recommend Company position, and provide technical support federal affairs department and other affected departments.

6) Manage tax audits and negotiate liability with tax authorities. Assign and review related tax analysts' tasks.

7) Research tax issues, apply law to facts, and provide written advice to PNW and all subsidiaries.Determine impact of changes in tax law or interpretation and supervise analysts in applying changes to Company operations.

8) Oversee preparation and filing of Forms 1099. Advise on the filing of Form W-2 and related payroll compliance activities.
